Mediation Services
Mediation is a dispute resolution process whereby the mediator meets with the parties to the dispute in a group (if possible and practical) and also individually. The goal of the mediator is to ensure all parties have the same understanding of accepted facts and disputed issues. After that, the mediator attempts to facilitate communications and negotiations among the parties regarding the issues at dispute. The mediator works with the parties to develop options, consider alternatives, and to reach a consensual settlement that will be acceptable to all involved.
Benefits of Mediation:
- Privacy and confidentiality
- The mediator is objective and helps the parties explore alternatives
- The process of mediation is quicker than going to a trial
- The process is less expensive as than a trial as both parties share in the cost of a mediator
- The possibility of continuing the business relationship later is much greater, since the dispute has been resolved with consideration of both parties
- The mediator may be able to propose creative solutions or accommodations, but no decisions are forced upon a party
- In a trial, typically, one party loses and one party wins. In mediation, the parties determine their own fate
